The letter of Understanding reads that “The Employer and the Union agree to meet to review the individual performance of stores that are experiencing financial difficulties or whose continued viability is questionable.” In the past the Company has served us notice for individual stores and not a block of locations. We believe that the language is not meant to deal with multiple stores together but one location at a time as the Company is obligated under the language to “provide full financial disclosure for the store being reviewed to the two senior officials of the Union.” Obviously the financial position of individual stores will vary greatly.

The language also calls for “joint, co-facilitated meetings with store employees to discuss improvements in the particular store” Often a committee of members from the Store is established to meet with the Company throughout the process.

Also of concern is that the list of locations the Company has provided contains stores that have already gone through the Joint Union/Management Review process. We believe the language does not contemplate a store going through the Review more than once and will strongly oppose any such attempt.

We are reviewing the request with legal counsel and will be responding to the Company shortly. We will post updates on the website so please check back often.
