Local 1518 Committee Recommends Acceptance, Members to Vote

After a review this morning and early afternoon, the Local 1518 Union Negotiating Committee has unanimously agreed to recommend acceptance of the terms of settlement mediator Mr. Vince Ready put forward to resolve the dispute between the union and Overwaitea.

Union members in Zone 1 will be voting upon the recommendations on Sunday July 6, and Monday, July 7."In reviewing Vince Ready's recommendations, the Union Negotiating Committee was satisfied that a number of hot-button issues that members wanted addressed were improved," said Ivan Limpright, President of UFCW 1518. "Mr. Ready made a very good case that this is going to be the best agreement possible."

Your Local 247 Negotiating Committee will be meeting to examine the settlement and will comment further if it is ratified.

Efforts to resolve negotiations dispute continue between Local 1518 & Overwaitea

Mediator Mr. Vince Ready issued his recommendations for terms of settlement regarding the dispute over a new contract between Local 1518 and Overwaitea.

The Local 1518 Union Negotiating Committee is currently reviewing the 18 page document.

Local 247 officers do not feel that a strike is imminent at this time and expects business to be as usual over the weekend in the Save-On Foods stores. It will likely take another day or two for the Local 1518 Negotiating Committee and the company to review these recommendations.

Local 247 members should continue to check the website and the negotiations telephone hotline for updates as they develop regarding this situation.

Local 1518 and Overwaitea negotiations:  Mediator Vince Ready to provide recommendations

Mediator Vince Ready advised both Overwaitea senior management and the 1518's Negotiating Committee late last night that he will be providing written recommendations to settle the dispute over terms for a new collective agreement.

Further information will be posted as it becomes available.

 Local 1518 and Overwaitea to Meet Monday

Mediator Mr. Vince Ready has advised both Local 1518 and Overwaitea senior management to be prepared to meet with him at 10:00AM Monday morning (June 30) regarding the current contract negotiations.

The terms of Section 74 dictate that a labour dispute can not begin until 48 hours after the mediator has booked out, and consequently, picket lines will not go up as originally planned.

Union members should prepare for a "normal" work week, and are advised to continue monitoring the union website and telephone infoline for the latest news from negotiations. Further information will follow as the negotiations conducted with Mr. Ready's assistance take place on Monday.

Update on Overwaitea Application to LRB for Mediator

UFCW Local 247 was contacted by Local 1518 early Thursday evening and was advised that Overwaitea has applied to the Labour Relations Board (LRB) for a mediator to become involved and for the parties to come back to the bargaining table.

If the LRB approves the Company’s application and appoints a mediator then the picket line will not go up as scheduled. This is what we anticipate happening. As soon as we have confirmation of the mediator’s appointment, we will advise our members. However, please be aware that this may not occur until later in the day on Friday so please continue to check the ufcw247.com website and the negotiations hotline at 1-866-789-8329 for updates. At this time, we are advising our members to continue to work their scheduled shifts.

We are not asking Picket Captains to report to the Surrey office on Sunday June 29th as previously scheduled.

If a dispute does occur we will be updating members with the procedure for reporting for picket duty at that time. We will be allowing Local 1518 to set up their picket line first in order to avoid the confusion of trying to establish our support picket line at the same time.  Once again, if the Company asks you to report to work during a dispute, we expect all 247 members to honour the Local 1518 picket line.

The Local 247 support line will be established under the direction and policies of Local 247. Local 247 members who are support picketing will be under the direction of Local 247.  They will be scheduled and directed by the Local 247 Picket Support Captains.  The Captains will report to one of 3 Local 247 Area Captains and the Area Captains will report directly to either Suzanne Hodge or Dan Goodman.  The Local 247 Picket/Support line will likely operate under different hours than the Local 1518 picket line to be determined once the strike actually begins.

The Picket/Support Captains will explain all details regarding support picketing, hours and pay to those who report for picketing if a dispute occurs.

Yesterday Local 1518 posted a number of items on their website under the heading: "Here is what we're fighting for... UFCW Local 247 members should take particular note of points #13 and #15 on that notice.  If Local 247 wins their unfair labour practice regarding the conversion of Save-On Foods Stores to PriceSmarts those are the conditions that we expect will be restored to the 247 members in the converted stores along with their membership rights in Local 247.

Local 247 remains hopeful that we will win the unfair labour practice complaint regarding the conversion of Save-On Foods stores to Price Smarts.  A decision from the LRB has yet to be issued.

Overwaitea Applies to LRB for Mediator

We were notified by Local 1518 that they received confirmation late Thursday afternoon that Overwaitea has applied to the Labour Relations Board (LRB) for a mediator to become involved in negotiations.

There had been no indication by the close of business Thursday as to whether the LRB will appoint a mediator, and it is expected the Board will make a decision on the company's application on Friday.

As soon as the LRB's decision on the appointment of a mediator has been issued, the union will post the information on the union website.

What Are They Thinking??

On the eve of a strike, Overwaitea/Save-On is canvassing employees to see if they wish to take vacation during the time period of the potential dispute. Unfortunately they are going a little further than suggesting when they, in bold print on notices posted in the stores, have told team members that for anyone on vacation –“NO PICKET DUTY”. Last time I checked, the Company has no say on your actions during your vacation time and in fact this may be a violation of Section 5 of the Labour Relations Code.

The Company is also running around asking members why they voted down the settlement offer.... Local 247 members. Perhaps they forgot that there were two Local Unions represented in the store and that we don’t vote on Local 1518 memorandums. Clarification for the Company- we’re the ones working in the meat/ deli/ seafood departments with the cleaver pins that say UFCW 247 on them.

Possible Dispute Update

As you are aware Local 1518 served perishibility notice on Wednesday afternoon June 25.  Local 1518 intend to begin picketing at 6pm on Saturday June 28.

**Please note the important change in time and date for the reporting of Local 247 Picket Captains and Local 247 members if a dispute should occur.Local 247 Picket Captains should report to the Local 247 Office in Surrey, 14936 32nd Avenue at 10 am on Sunday June 29. 

Local 247 members who wish to picket should report to the 247 Picket Captain in front of your home store at 1 pm on Sunday June 29.  Your Picket Captain will be clearly identified as the Local 247 Captain.  Please do not report to the Local 1518 picket line or to the Local 1518 Picket Captains.

If the company decides not to attempt to keep the stores open to the public for business Local 247 members will be expected to respect the Local 1518 picket lines by not crossing them.  It the Company decides to keep management inside the closed stores to perform clean-up, inventory or any other function Local 247 members will be expected not to join them or cross the picket line or perform any job function of any kind behind the picket line.

The company will likely not be issuing layoff notices to Local 247 members.  This does not mean that you are obligated to cross or work behind a picket line.

Local 247 have been advised by several different competitors that they will be looking to hire extra help during the dispute if it should occur. We can assist you in that regard and you may also picket so there is no reason why any 247 member would need to cross or work behind the picket line. We are aware that the Company is having departmental meetings with their managers and suggesting to them that there will be work for them in the store in the event of a dispute. We are also aware that Local 247 members are being approached by management and that management is implying that Local 247 members should cross the picket line. Local 247 members are expected to honor the Local 1518 picket line and not cross or work behind it.

Local 1518 Members Reject Settlement

Local 1518 members employed at Save-On have rejected the offer of settlement by 58%. Perishability notice will be issued by Local 1518 today and a strike could occur as early as 6 p.m. Saturday, June 28th.

What does this mean for Local 247 members and what will happen if a strike begins?

Local 247 members  will be expected to honour the Local 1518 picket lines.

Will the company close the stores for business during a strike?

If the company should attempt to keep the stores open for business during a strike Local 247 members will be expected to respect the Local 1518 picket lines by not crossing them and not going in to work.

What do we do if a strike begins with local 1518 on Sunday and where do we go?

Local 247 Picket Line Captains will be asked to report to the UFCW 247 Office in Surrey at noon on Saturday June 28th. Local 247 Members who intend to picket in support of Local 1518 will be asked to report to their picket line captain at  the store that they work at 6:00 pm on Saturday, June 28th. Picket line captains will be identified prior to a dispute commencing. Please remember that the times and days listed above are subject to change and you will be notified of any changes.

How will we be notified as things change?

The 247 Membership servicing crew will be in your stores every day for the remainder of this week and over the weekend. You may also check the Local 247 website at:  www.ufcw247.com  for new information and the Local 247 negotiations hotline at:1-866-789-8329.

Do I have to picket?

No, but you will not receive any picket pay.

How many hours per week will I have to picket in order to receive picket pay.

A breakdown of hours an pay will be distributed to 247 members prior to the strike commencing or by the picket line captains when you report to your home store.

Can I work for another banner of Overwaitea, such as Price Smart, during a strike with Save-On Foods?

Local 247's position on this issue is as follows: If a 247 member should choose to work for another banner of Overwaitea such as Price Smart or Urban Fair or Coopers during a Labour dispute with Save-on, you will not be allowed to picket nor will you be paid any picket pay from local 247. The reason for this is clear. Your employer may attempt to run and or move their business through one or more of their banners during a dispute with Local 1518 in an attempt to undermine the effectiveness of the Local 1518 picket line. Local 247 will not support that in any way.

Can I work for another competitor of Overwaitea, such as Safeway, IGA  or Real Canadian Superstore during a strike with Save-On Foods.

Yes. We would encourage our 247 members to seek alternate employment during a strike.

Can we picket a the store closest to where we live.

Not for the first week of the strike. After that we will try to accommodate everyone.

Can we picket Price Smart stores or Urban Fair stores?

No as they are not on strike.

Has there been a ruling yet from the Labour Relations Board on the Price Smart case yet?

No.

Will there be a ruling soon?

We hope so.

Will the company serve lock out notice?

We don't know but they could.

Would the strike or a lockout include Zone 2 members?

No, only Zone 1.

Local 1518/ Overwaitea Settlement

Many Local 247 Overwaitea members have been calling the Union office and asking questions about the Local 1518/ Overwaitea memorandum of settlement. Members want to know if the 247 Bargaining Committee will be heading in the same direction and agreeing to the same things outlined in the memorandum.We want to make it clear that we were not involved or present during the 1518-Overwaitea bargaining and are still in the process of breaking down the memorandum. We have not had the opportunity to ask questions or get clarification from Local 1518 and we wish to gain a clear understanding of the many changes and discussions that took place in reaching this settlement before commenting on it. We have not yet agreed to further bargaining dates with the Company and at this time we have not seen any monetary proposals from the Company so any comment on what may or may not happen would be pure speculation. We anticipate resuming bargaining on the issues raised by 247 members through the proposal package already presented to the Company

What`s Happening??

Many Local 247 members have been calling the office and asking what is happening with Local 1518 and their negotiations. Rumours are floating throughout the store about both settlements and strikes. At this point, Local 1518 and the Company continue to meet with the assistance of Mediator- Mr. Brian Foley. Mr. Foley issued his recommendations for settlement of a new contract on June 15 and the parties have been reviewing the document since. We have not been told the details of the document and anything you may be told from anyone claiming to have knowledge of the document, such as a Supervisor, is most certainly a guess or lie, and not fact.

We expect to be in contact with Local 1518 as the process continues and will update you with any new information as soon as possible.

Local 1518 Issues 72 Hour Strike Notice to  Overwaitea

Effective June 8th, Local 1518 has served 72 hours strike Notice to Overwaitea Foods.
Perishability Notice has not been served.
Local 1518 has indicated that some progress was made regarding their key issues and the negotiations would continue on Monday June 9th with the assistance of mediator Brian Foley.

Local 247 is of the opinion that strike action by Local 1518 is not imminent and that negotiations between Local 1518 and the company will continue for the remainder of the week.

 

As we are made aware by Local 1518 of any further progress or deterioration in these negotiations we will update the Local 247 members via the web site and or our servicing representatives.

My name is Laurie Orr. I've worked at Save-On Foods for 34 years as a meat cutter. I have been an active shop steward since 1985 and a member of the bargaining committee since 1993.

My name is Linda Cripps. I am the head meat wrapper at Pentiction store #962. I became a member of UFCW Local 2000 in 1979 as a Woodwards employee and then went to Overwaitea and now Save-On Foods.

My name is Guy Fraser. I have been at Save-On Foods for 22 years and have been a long serving shop steward and bargaining committee member. I believe that organized labour plays an important role in providing social
justice for all.

My name is James "Reg" Goddard. I am a shop steward at Save-On Foods store #903. I have sat on the bargaining committee since 1993 and I was involved in the organizing drive at J&L Meats back in 1992.
